□ An Indonesian singer reported copyright piracy of his song <selebritis.infogue.com> July 2, 2009 Song of an Indonesian singer, Afgan Syah Reza, entitled Bukan Cinta Biasa (Not a Common Love), has been sneaked by a telecommunication operator in Malaysia, Maxis. Afgan reported this case to Ministry of Domestic Trade and Consumer Affairs of Malaysia. “We will report it, whether for criminal or civil case, since there is obviously a legal violence and it has stimulated financial loss. We will make a legal claim in Malaysia through Law Enforcement Division of the Ministry of Domestic Trade and Consumer Affairs,” said Handra Deddy Hassan, an Afgan’s advocate. Even though there is an attempt to settle the case outside the court, the parties have not been able to settle the demand of each other yet. Therefore, the case might be brought to the Court‘s consideration soon. □ Conflict in Copyright of a Balinese artist <tempointeraktif.com> June 9, 2009 The maestro of Balinese painter has proposed a case of the selling of the fake version of his paintings in a gallery in Denpasar. At the court, the judges stated that the paintings were clearly counterfeit and the signature attached in them was not identical to that of Nyoman Gunarsa. Impetuously, in a verdict No. 219/Pid.B/2007/PN.DPS, the judges concluded that Gunarsa has no any copyright toward the paintings and has no right to convey it to the police. Due to such decision Nyoman Gunarsa asked a number of law experts to examine the verdict. A law expert was surprised at the decision. Logically, he continued, when the act of counterfeiting Gunarsa’s paintings is revealed, the gallery could brought the case to the court if it were the gallery’s own. In fact, there is a sticker in every painting stating that it is Nyoman Gunarsa’s works. Gunarsa obviously has a right to propose a claim since he is the copyright holder of the works. ........................... |
