Overview of broadcasting industry

The recent amended IP law approved by the National Assembly has some important changes, including changes for better interpretation of the existing law and changes to improve the existing law, i.e. to address some technical error and to bring the current legislation in line with some international copyright conventions, to which Vietnam is a party. Despite these changes, there are some loop-holes need to be addressed which will be mentioned in more details in this report.

As far as TV broadcasting is concerned, the changes focus on the use of published works by broadcasting organizations, the classification of copyright royalty based on the purposes of use of such works and the term of copyright protection of some relevant works.

From practical aspect, for every TV station, copyright is always a matter of their great concern. From the competition for obtaining license to broadcast big sport and culture events such as World Cup, Miss World to the combat against copyright infringement. On the one hand, as a right holder, a broadcasting organization can be vulnerable to copyright infringement to various types of their works. On the other hand, as a big user, they face many complaints and possible legal actions from third parties claming infringements of their works.
